PT Binasawit Abadipratama (eks PT Agro Mandiri Perdana) melakukan proses tukar menukar kawasan hutan berdasarkan Peraturan Pemerintah (PP) Republik Indonesia (RI) nomor 10 tahun 2010, sebagaimana telah dirubah dengan PP RI nomor 60 tahun 2012 tentang perubahan atas PP nomor 10 tahun 2010 tentang tata cara perubahan peruntukan dan fungsi kawasan hutan. Selanjutnya dicabut dengan terbitnya PP nomor 104 tahun 2015 tentang tata cara perubahan peruntukan dan fungsi kawasan hutan.
“Binasawit Abadipratama mengajukan permohonan kepada Menteri Lingkungan Hidup dan Kehutanan (LHK), terkait permohonan penyelesaian pelepasan kawasan hutan atau TMKH sesuai dengan pp 60 tahun 2012,” kata Bupati Seruyan Yulhaidir, yang diwakili Kepala Bappedalitbang setempat, Budi Purwanto, Sabtu Sore, (4/2/23).
Dijelaskannya, atas permohonan ini mewakili Menteri LHK, Kepala Badan Koordinasi Penanaman Modal RI menerbitkan surat persetujuan prinsip nomor s.22/1/klhk/2021 tanggal 15 maret 2021, hal persetujuan prinsip TMKH, untuk perkebunan kelapa sawit atas nama Binasawit Abadipratama seluas 17.423 ha di wilayah Seruyan.
“Persetujuan TMKH, pada angka 4 point h menegaskan Binasawit Abadipratama dibebani kewajiban mencadangkan areal untuk kebun masyarakat seluas ± 3.485 ha (20%) dari kawasan HPT dan HP yang akan dilepaskan menjadi Areal Penggunaan Lain (APL),” ujarnya.
Menurutnya, pemda dengan ini menolak untuk menandatangani berita acara tata batas persetujuan prinsip TMKH untuk perkebunan Binasawit Abadipratama, yang berlokasi di wilayah Kecamatan Danau Sembuluh dan Kecamatan Seruyan Raya.
“Penolakan ini sesuai hasil penataan batas areal persetujuan prinsip TMKH Binasawit Abadipratama yang tidak di plotting/dicadangkan untuk kebun masyarakat seluas ± 3.485 ha (20%) dari kawasan HPT dan HP yang akan dilepaskan menjadi APL,” tambahnya.
