SKNEWS, PULANG PISAU – Bertempat di Aula Kantor Kejaksaan Negeri Pulang Pisau, Kajari Pulang Pisau Dr.Priyambudi,S.H.,M.H didampingi Kasi Pidum Harisha C. Wibowo S.H., dan Kasubsi Penuntutan Chabib Sholeh, SH secara resmi menyerahkan Surat Ketetapan Penghentian Penuntutan (SKP2) kepada Tersangka a.n. Hendro Alias Gendut Bin Layar T. Silay yang didampingi orang tua dan keluarganya. Hal tersebut merupakan tindak lanjut dari pelaksanaan perdamaian dalam proses penghentian perkara melalui upaya Restorative Justice yang oleh jajaran Kejari Pulang Pisau dilakukan dengan menggunakan kearifan lokal, yakni prosesi adat Tampung Tawar.
Disebutkan Kajari Pulang Pisau bahwa Restorative Justice merupakan paradigma baru dalam Penegakan Hukum. Dimana hal ini merupakan suatu wujud dari keadilan yang berpusat pada pemulihan pada keadaan atau kerugian korban, pelaku kejahatan, serta masyarakat, dan bukan lagi hanya tentang penegakan hukum Retributif atau pembalasan.
“Penghentian Perkara melalui upaya Restorative Justice kali ini diberikan kepada Tersangka a.n. Hendro Alias Gendut Bin Layar T. Silay yang disangka melanggar ketentuan pasal 351 Ayat (1) Ke-1 KUHP tentang penganiayaan. Adapun kronologis singkatnya berawal pada saat TERSANGKA sedang istirahat setelah memotong daging untuk acara syukuran ditetangganya.” Ucapnya
Diceritakan bahwa tidak lama kemudian Saksi Jonny Irawan datang dalam keadaan mabuk menghampiri TERSANGKA sembari menantang TERSANGKA berkelahi, karena TERSANGKA juga melihat Saksi Jonny Irawan memalak warga yang berada disitu untuk membeli minuman alkohol sehingga membuat TERSANGKA yang juga pada saat itu dalam keadaan mabuk semakin naik pitam/emosi, kemudian TERSANGKA berdiri sambil mengambil parang yang terbuat dari besi dengan panjang ± 59 Cm yang terletak disamping TERSANGKA atau tepatnya di lantai, lalu Tersangka mengayunkan Parang menggunakan tangan kirinya kearah Saksi Jonny Irawan dan mengenai punggung kiri belakang sehingga mengakibatkan punggung kiri belakang Saksi Jonny Irawan luka robek dan mengeluarkan darah.
Kemudian, tersangka dan Saksi Jonny Irawan langsung dilerai oleh warga. Selanjutnya, Saksi Jonny Irawan langsung dilarikan ke rumah sakit terdekat. Akibat perbuatan Tersangka tersebut Saksi Korban Jonny Irawan Alias Pentet mengalami luka sebagaimana dalam Visum et Repertum yang dilaksanakan di Rumah Sakit Jiwa Kalawa Atei.
Dr. Priyambudi,S.H.,M.H menegaskan, penghentian penuntutan berdasarkan Keadilan Restoratif ini harus melalui proses tahapan dengan persyaratan yang harus dipenuhi sebagaimana diatur dalam Peraturan Jaksa Agung RI. Tim JPU harus melakukan pemaparan kepada pimpinan untuk mendapatkan persetujuan.
Dalam Ekspose secara virtual yang dipimpin oleh Agnes Triani, SH., MH. Direktur Tindak Pidana Terhadap Orang dan Harta Benda pada JAMPIDUM, Kajari Pulpis Dr. Priyambudi, S.H., M.H bersama Tim JPU kembali berhasil mendapatkan persetujuan penghentian penuntutan berdasarkan keadilan restoratif pada pertengahan Juni. Upaya penghentian penuntutan ini tak lepas dari upaya Kajari Pulpis untuk terus mendorong para JPU Kejari Pulpis agar mengedepankan hati nurani dalam menangani suatu perkara, sekaligus memperhatikan nilai-nilai kearifan lokal yang ada dan hidup di masyarakat.
Setelah proses mediasi yang difasilitasi oleh JPU yang dipimpin Dr. Priyambudi, SH., MH melakukan musyawarah secara kekeluargaan antara keluarga tersangka dengan keluarga korban dan menghasilkan perdamaian serta keadilan bagi semua. Selanjutnya diselenggarakan prosesi adat Tampung Tawar di Saung Keadilan Restoratif Kejari Pulang Pisau oleh Damang dan Mantir (tokoh adat di Desa tempat tinggal korban dan tersangka) diharapkan amarah, dendam, dan sakit hati akan mereda dan kebaikan akan menggantikan pertikaian di dalam hati mereka.
Dengan penyelesaian perkara melalui pendekatan Keadilan Restoratif dan menggunakan kearifan lokal ini, tersangka beserta keluarga mengungkapkan rasa syukur, sementara pihak korban menyambut dengan senang hati.
